This Service Agreement sets out specific terms and conditions applicable to 4Cloud’s Domain Registration Service (“Domain Registration”). This Service Agreement forms part of the Agreement between you and 4Cloud, which also includes: (1) the Service Terms; (2) any other Service Agreements for other 4Cloud Services to which you have subscribed; and (3) any other 4Cloud document describing features, products or services and any other document incorporated by reference.
In the event of an inconsistency between the constituent documents of the Agreement, the inconsistency will be resolved by giving preference first to a Service Agreement(s), then to the Service Terms, then to any other 4Cloud documentation describing features, products or services and finally to any other documents incorporated by reference.
Unless otherwise defined herein, all capitalized terms in the Service Agreement have the meaning assigned to those terms in the Service Terms.
1. How do I accept this Service Agreement?
You acknowledge that you have read, understood and agreed to this Service Agreement by either: (i) placing an order for Domain Registration by any means including online or over the phone; or (ii) using Domain Registration.
If you do not agree to the Service Terms or this Service Agreement, or any other parts of the Agreement, you may not use Domain Registration. If you are using Services on behalf of a business (e.g., your employer or a contractor) or other legal entity, you represent that you have the authority to bind that company or other legal entity to this Service Agreement.
2. What is Domain Registration?
Domain Registration allows you to register a domain name for your website. Domain Registration also includes support services.
3. How do I select a Domain Registration service package and service features?
The Website provides information and pricing for all Domain Registration service packages, including the availability of different domain extensions. With reference to the service information and pricing on the Website, you select your service package when placing an order for Domain Registration.
4. Can I register any domain name?
No. Your desired domain name must conform with certain rules. For instance, spaces and special characters cannot be included in a domain name. The domain name that you wish to register must also be available. Prior to submitting your order, your proposed domain name will be tested for eligibility.
5. What happens after I place my order?
When you place your order, 4Cloud process your Domain Registration request. Once processed, we will send an email address that you designated for communications with us relating to your Services.
6. What Term applies to Domain Registration?
The Term of this Service Agreement is equal to the registration term (up to ten years) that you have selected when submitting or renewing our Domain Registration order. You can set your Domain Registration to auto-renew at the end of the registration term.
7. Does my registration give me a guaranteed license to use the domain throughout the Term?
No. Your registration is not immune from domain name disputes. Your continued registration also depends on compliance with the terms of the Agreement.
8. Do I need to ensure that my registration information is accurate and up to date?
Yes. You must notify us of any changes to the registration information for your registered name holder, technical contact, administrative contact and billing contact. Registration information includes: name, address, email address, phone number and fax number.
9. When using Domain Registration, am I subject to any registry policies?
Yes. By using Domain Registration, you agree to any registry policy(ies), including domain name dispute resolution policies, that apply to the domain extension that you have chosen. A list of links to registry websites is published on our Website . It is your responsibility to visit the applicable registry website and read and review all applicable registry policies prior to submitting your order for Domain Registration.
10. Do I own my domain name?
No. Registration of a domain name does not convey a proprietary right. Domain Registration shall not be construed as evidence or ownership of the registered domain name. Registration provides a limited licence to use the domain name.
11. What happens when I cancel Domain Registration?
If you cancel your Domain Registration, your registration will be terminated. You agree that no refunds will be issued for Domain Registration that is cancelled prior to the expiry of the Term. Once Domain Registration is cancelled, your formerly registered domain name will be made available on a first-come-first-serve basis.
12. How do I obtain technical support for Domain Registration?
If you require support for Domain Registration, billing or any other service matter, submit an email to support@4cloud.ca and a 4Cloud agent will assist you as soon as possible. Support is available twenty-four hours a day, all year round.
